What is a Washington Dangerous Dog Bond?

  • A Washington Dangerous Dog Bond is a $250,000 surety bond that can be posted by the owner of dangerous dog.
  • Washington Statutes § 16.08.080 requires the owner of a dangerous dog to present sufficient evidence of a surety bond or a policy of liability insurance in the amount of at least $250,000. The bond is payable to any person injured by the dangerous dog.
  • Per Washington Statutes, a dangerous dog is any dog that a) inflicts severe injury on a human being without provocation on public or private property, b) kills a domestic animal without provocation while the dog is off the owner’s property, or c) has been previously found to be potentially dangerous because of injury inflicted on a human, the owner having received notice of such and the dog again aggressively bites, attacks, or endangers the safety of humans.

  • Due to the risk from the perspective of the bonding company, these bonds are very carefully underwritten. In all cases, a credit check and full collateral will be required. This bond is for $250,000, therefore, the owner of the dangerous dog must post $250,000.00 in collateral to the surety company. This can be in the form of cash (via wire transfer) or an irrevocable letter of credit payable to the surety.
  • If the credit report checks out and full collateral is posted, the cost of the bond is usually between 1-2% of the bond amount. In this case, the bond could cost as low as $2,500 to $5,000 per year.
  • The surety bond remains in full force and effect as long as the owner possesses the dog. The bond is only canceled if the owner gives the dog up for adoption or if the animal passes away. Keep in mind that bonds have a statute of limitations. Some are very extensive, this means that even though you may not own the dog anymore, you are still liable for any damages that may have occurred while you did own the animal. That means if you give the dog away today, you are still liable for anything that happened while you had possession of the animal.
